1. Intellectual Property and Content Rights
By creating an account and hosting any performance on The Stage, you represent and warrant that you own or have obtained all necessary rights, licenses, consents, and permissions to perform, stream, and distribute any and all content included in your show, including but not limited to musical compositions, sound recordings, lyrics, arrangements, and any visual elements displayed during your performance.
You agree that The Stage is not responsible for obtaining any licenses or clearances on your behalf. You are solely responsible for ensuring that your performance complies with all applicable copyright laws, including but not limited to the rights of songwriters, publishers, record labels, and performing rights organizations such as ASCAP, BMI, and SESAC.
By submitting content to The Stage, you grant The Stage a non-exclusive, royalty-free, worldwide license to stream, display, and store your performance for the purposes of operating the platform, including replay access made available to ticket holders.
You agree to indemnify, defend, and hold harmless The Stage, its officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to any content you perform or distribute on the platform, including any claim that your content infringes the intellectual property rights of a third party.
The Stage reserves the right to remove any content that receives a valid copyright complaint and to suspend or terminate accounts that repeatedly infringe on the rights of others. The Stage complies with the Digital Millennium Copyright Act (DMCA) and will respond to valid takedown notices in accordance with applicable law.
2. DMCA Takedown Policy
The Stage respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), The Stage will respond promptly to valid notices of claimed copyright infringement.
Filing a Takedown Notice
If you believe that content on The Stage infringes your copyright, submit a written notice to our designated agent. Your notice must include:
- A physical or electronic signature of the copyright owner or authorized person.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the infringing material on The Stage with enough detail for us to locate it.
- Your contact information including name, address, telephone number, and email address.
- A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
What Happens After a Notice Is Filed
Upon receiving a valid takedown notice, The Stage will remove or disable access to the identified content promptly. The user who posted the content will be notified. Users who believe their content was removed in error may submit a counter-notice.
Filing a Counter-Notice
Submit a counter-notice to [email protected] that includes:
- Your physical or electronic signature.
- Identification of the content removed and where it appeared before removal.
- A statement under penalty of perjury that you believe the content was removed by mistake or misidentification.
- Your name, address, telephone number, and consent to the jurisdiction of the applicable federal district court.
Repeat Infringers
The Stage has a policy of terminating accounts of users found to be repeat infringers in appropriate circumstances.
Limitation of Liability
The Stage is not liable for content posted by users and acts solely as a passive conduit for user-generated content.
3. Content Policy
All content performed or distributed on The Stage must comply with this policy. The Stage reserves the right to remove any content and suspend or terminate any account that violates these guidelines.
What Is Allowed
- Original compositions and songs written and owned by the performer
- Cover songs where the performer has obtained the appropriate license or the performance qualifies under a blanket license held by The Stage
- Comedy, spoken word, poetry, and creative performances that are original or properly licensed
- DJ sets where the performer has obtained the appropriate performance rights
- Gospel, worship, and faith-based performances
- Instrumental performances and produced sets
- Pre-recorded performances that meet all content standards outlined in this policy
What Is Not Allowed
- Performances that infringe on the copyright of a third party without proper authorization
- Content that is sexually explicit or pornographic in nature
- Content that promotes, glorifies, or incites violence against any individual or group
- Content containing hate speech including material that demeans or threatens people based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
- Content that harasses, threatens, or intimidates any individual
- Content that promotes illegal activity including the sale or use of controlled substances
- Content that involves minors in any inappropriate or exploitative manner
- Content that is deliberately deceptive, fraudulent, or misleading
- Performances that include unauthorized use of third-party trademarks, logos, or brand assets
- Content that violates any applicable local, state, federal, or international law
Age Requirements
All performers must be at least 18 years of age to create an account and host shows on The Stage. By registering, you confirm you meet this requirement.
Fan Conduct
Fans participating in live shows through chat, superchats, and tips are expected to maintain respectful conduct. The Stage reserves the right to remove fans from any show and terminate accounts for harassment, hate speech, or any behavior that violates these guidelines.
Enforcement
The Stage may take the following actions in response to policy violations:
- Removal of the violating content
- Issuance of a warning to the account holder
- Temporary suspension of the account
- Permanent termination of the account
- Reporting to law enforcement where required by law
The Stage is the sole arbiter of what constitutes a violation and reserves the right to make enforcement decisions at its discretion.
Reporting Violations
If you encounter content that violates this policy, report it to [email protected] with a description and the show or account where it appeared.
4. Tickets & Account Usage
Tickets purchased on The Stage are personal, non-transferable, and subject to the rules below. By purchasing a ticket or creating an account, you agree to these terms.
Use of Your Ticket and Account
- Each ticket grants access for one (1) viewer on one (1) device at a time. Tickets are linked to your account and may not be resold, transferred, shared, or assigned to another person.
- One active stream per ticket. Live streams and VIP replays may be watched on only one device at any given moment. Opening the watch page on a second device will either be blocked or will end the session on the original device.
- Cost-splitting, group pooling, or otherwise using a single account to provide access to people who did not individually purchase a ticket is not permitted.
- You are responsible for maintaining the confidentiality of your account credentials. Do not share your email, password, login links, or any session URLs with others.
- The Stage uses technical measures to detect concurrent streaming, credential sharing, and other anomalous access patterns. These measures may include session binding, heartbeat checks, device heuristics, and rate limiting.
Enforcement
If The Stage detects concurrent streaming, credential sharing, or other misuse of a ticket or account, we may at our sole discretion:
- Automatically terminate all but one active viewing session.
- Require re-authentication or a password reset on affected devices.
- Suspend the account temporarily or permanently.
- Revoke access to the show without refund.
- Ban the account from future purchases on the platform.
No Refunds for Misuse
Tickets revoked or sessions terminated due to violation of this section are not eligible for refund. If you believe your account has been compromised, reset your password immediately and contact [email protected].
By creating an account on The Stage, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
